Penalties for oui in connecticut

Operating under the influence (OUI) of drugs or alcohol is illegal in all 50 states. While it’s an automatic violation of Connecticut law if a driver operates a motor vehicle on a public roadway with a blood alcohol concentration (BAC) of .08%, what many drivers do not realize is that they can be convicted of OUI with an even lower BAC.

All that matters is that the state can prove that the driver’s ability to drive safely was impaired by the introduction of alcohol or drugs, or both. In fact, someone can face OUI charges for driving under the influence of any amount of alcohol, lawfully prescribed medications, and even some herbal supplements that cause drowsiness.

OUI Penalties Under Connecticut Law

In Connecticut, the offense of operating under the influence of alcohol or drugs under CGS Section 14-227a is punishable by the following:

First OUI Offense

  • License suspension
  • Up to $1,000 fine
  • Up to six months in jail
  • Probation with 100 hours of community service
  • Mandatory Ignition Interlock Device (IID) for one year

Second OUI Offense

  • License suspension
  • A fine up to $4,000
  • Up to two years behind bars
  • Probation with 100 hours of community service
  • Mandatory Ignition Interlock Device (IID) for three years

Third OUI Offense

  • Permanent license revocation
  • A fine up to $8,000
  • Up to three years behind bars
  • Probation with 100 hours of community service

Lesser-Known Consequences of an OUI

In addition to the above penalties for OUI, there are many other ways that an OUI conviction can affect your everyday life. OUIs typically impact housing and employment opportunities, employment background checks, college scholarships, college-level athletics, professional licenses, auto insurance premiums, immigration status, security clearance, international travel, and in some cases, child custody.
