3 components of a strong dui defense case

A successful DUI defense strategy requires in-depth knowledge of the law. If you want to have your DUI charges dropped, you will need to hire a lawyer who has experience with DUI with cases. A good attorney will help you obtain the evidence you need to fight against your DUI charges. Collecting evidence as soon as possible is critical to your case, which makes finding legal help all the more important. Below, we explain 3 defenses that can be used to challenge DUI charges.

#1: CHALLENGE THE SYMPTOMS OF INTOXICATION

Sometimes, the symptoms of intoxication are similar to the symptoms of numerous medical conditions. Police often test for DUI if a suspect has: red or watery eyes, slurred speech, a flushed face, or unsteady posture. While police will claim that these symptoms are an objective way to spot intoxication, an experienced attorney can argue against the validity of these methods. Intoxication symptoms can be caused by allergic reactions, fatigue, illness, irritated eyes, and various medical conditions.

#2: FIELD SOBRIETY TESTS CAN BE INACCURATE

The prosecution will try to use the results of field sobriety tests to build their case. However, these tests lack scientific merit and accuracy. Police usually use these tests to build up their reasoning for performing further DUI chemical testing.

A good attorney can argue that field sobriety test results were impacted by things like:

  • Poor Physical Health
  • Nervousness
  • Fatigue
  • Environmental Factors
  • A Police Officer’s Poor Training

#3: THE 15-MINUTE OBSERVATION PERIOD WAS IMPROPERLY CONDUCTED

The arresting officer is supposed to observe you for at least 15-minutes before issuing a DUI breath test. If the officer fails to properly adhere to the guidelines of the 15-minute observation period, your lawyer can use it against them in court. Some officers will fail to observe the suspect at all and will instead complete paperwork and/or set up the breath test during the observation period. If you can prove that the officer did not properly observe you, it can put the prosecutions entire defense at risk.
