Administrative Per Se Hearing Outcomes
If you win the DMV hearing, you will not receive a license suspension nor will you have to drive with an Ignition Interlock Device. However, this hearing is separate and distinct from the Court action, where jail, fine fee, and costs may be imposed if you are convicted of a DUI. In addition to these penalties, a conviction also results in an additional license suspension plus a requirement to drive with an Ignition Interlock Device (IID) after your license has been restored.
That said, if you are unable to win your case at the Department of Motor Vehicles, there are other options to help relieve the stress and hardship a suspended license may have on your life. If you qualify, you may be able to obtain a special permit to drive to and from work and school, for example (there are certain restrictions). This special permit to drive allows you to use any car you want in order to drive. However, you may only drive during the prescribed time periods and days listed on the permit. You will also need to drive with an Ignition Interlock Device (IID) after your license is restored. However, driving with the IID allows you to drive wherever and whenever, but only in the car with the IID.
